1. Overview & Acceptance
Welcome to BookCraftly (“we”, “us”, “our”). These Terms of Service (“Terms”) form a binding agreement between BookCraftly and you (“you”, “user”) governing your use of our website, apps, and services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you don’t agree, don’t use the Service.
- The Service is intended for users 18+ or those with parental consent.
- Where referenced, plan-specific terms or offer pages form part of these Terms.
- If you purchased via a marketplace (e.g., W+ / JVZoo / ClickBank), their terms also apply to the transaction layer.
2. Accounts & Security
- You must provide accurate registration information and keep it up to date.
- You are responsible for all activity under your account. Use a strong password; keep it secret.
- We may (and sometimes must) verify identity for billing, fraud prevention, or marketplace compliance.
3. Plans, Billing & Credits
BookCraftly offers one-time and subscription plans. Some plans include a credit system used for content generation features.
- Subscriptions: Billed in advance on the stated interval and renew automatically until canceled.
- Credits: Credits included per plan are consumed when you run generation tasks. Expiry/rollover rules are shown on the pricing/checkout page for your plan.
- Cancellations: Take effect at the end of the current term. Access remains until that date.
- Refunds: See our Refund Policy for exact criteria and process.
- Taxes & Fees: You’re responsible for applicable taxes. Processor/marketplace fees may apply.
4. AI Providers & Costs
BookCraftly integrates with third-party AI providers (e.g., OpenAI/Claude/Mistral/Replicate). Depending on plan, you may need to connect your own API keys and will be responsible for those provider charges. Estimates shown in our UI are informational only; actual spend is determined by the provider and your usage.
- You must comply with each provider’s terms when using their models via BookCraftly.
- We may change default models or add/remove providers to ensure reliability and quality.
- AI outputs require your review. You are responsible for verifying accuracy and rights clearance.
5. Content & IP Ownership
You own the original content you create with BookCraftly (“User Content”). You grant us a limited, non-exclusive license to process and host your content solely to provide the Service (including backups, caching, and fraud/security checks).
- AI outputs: Eligibility for copyright varies by jurisdiction. You are responsible for ensuring outputs do not infringe third-party rights and for making any required disclosures.
- Our IP: Platform code, templates, UI, brand, documentation, and proprietary models remain our property.
6. Acceptable Use
Do not use BookCraftly to:
- Violate laws or third-party rights (including copyright, trademark, privacy).
- Generate or distribute unlawful, hateful, or explicit content; harass or defame others.
- Upload malware, attempt to break security, or scrape/rate-limit dodge.
- Deceptively impersonate, spam, or mislead audiences.
7. Publishing & Distribution
- BookCraftly exports (PDF/EPUB/flipbook/audio) and metadata helpers are tools; final compliance with platforms like Amazon KDP remains your responsibility.
- If we offer optional distribution or store integrations, you authorize us to transmit your content and metadata to those channels. Channel policies apply.
8. Service Availability
We aim for high uptime, but the Service is provided “as is” and “as available.” Maintenance windows, provider outages, or force majeure may interrupt access. Keep local backups of important work.
9. Termination
- You may cancel at any time from your account or by contacting support.
- We may suspend or terminate for violations, fraud/abuse, non-payment, or risk to the Service/others.
- Upon termination, we may retain backups for a limited time; export your data beforehand.
10. Disclaimers & Liability
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND (EXPRESS OR IMPLIED), INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI OUTPUTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKCRAFTLY WILL NOT BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE AMOUNTS YOU PAID TO BOOKCRAFTLY FOR THE SERVICE DURING THAT PERIOD.
11. Indemnification
You agree to indemnify and hold BookCraftly, its officers, employees, and partners harmless from claims arising out of your content, your use of the Service, or your violation of these Terms or third-party rights.
12. Governing Law & Disputes
These Terms are governed by the laws of Delaware, USA (without regard to conflict-of-law rules). Disputes will first be addressed via good-faith support escalation. If unresolved, they will be submitted to binding arbitration in Delaware, USA, except that either party may seek injunctive relief in court for IP or security matters. Class actions are waived.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified in-app or by email. Continued use after an update means you accept the new Terms.
